Probate
We undertake all aspects of work relating to probate and the administration of a deceased’s estate. Because each estate is different in size and complexity, we do not offer a standard fixed fee for this work. Instead, work is charged at an hourly rate of £220 plus disbursements.
We offer an initial consultation for a fixed fee of £125. The purpose of this consultation is to establish what the estate consists of and what work is required. Clients are then given an estimate of our likely fees based on the information provided.

For a basic estate where the main asset is the deceased’s residence and the estate does not exceed £325,000 and the estate is passing to the deceased’s spouse and children, our fees would not normally exceed £1,000 plus disbursements.

For a more complicated estate where there are other assets such investment properties or shares and there is potentially inheritance tax to pay, our fees are more likely to be between £3,000 and £5,000 plus disbursements. Our fees will vary depending on the size and complexity of the estate as well as the provisions of the deceased’s will.

In addition to our fees, there will be a number of disbursements which we will have to pay out during the course of handling the estate. The most common disbursements are:

• £155 to the Probate Registry. This is the court fee payable when submitting the application for the Grant of Representation (plus £1 for each additional copy of the Grant of Representation that is required).
• £87.84 to The Gazette. This is the fee payable for placing a notice in The Gazette to notify any creditors of the deceased that they must come forward. It may also be necessary to place similar notices in the deceased’s local paper which will incur an additional fee.
• £2 to HM Land Registry for bankruptcy search (per beneficiary)

The fees set out above do not include any of the following:
• Disputes relating to the deceased’s will
• Claims against the deceased’s estate under the Inheritance (Provision for Family and Dependants) Act 1975
• Variations to the disposition of the estate
• Conveyancing work relating to the sale or transfer of any property owned by the deceased
• Claims brought on behalf of the estate
• Tracing missing beneficiaries

Each person’s estate will have a different combination of assets and liabilities. Because of this, the time it takes to complete the administration of estate varies and will be dependent upon the circumstances of the individual.
We provide an estimated timescale at the initial consultation.
Those timescales may change if unforeseen circumstances arise, such as, if assets or liabilities which the executors were not aware of at the outset subsequently come to light.
In such circumstances we will provide revised timescale and fee estimate.

Employment
It is often very difficult to provide an accurate costs estimate in an Employment Law case

as the amount of costs are likely to be subject to so many different factors including the

value of the claim, the issues to be determined and the complexity of the case,

in order to get an accurate view of your specific circumstances we offer

a fixed fee initial appointment at a cost of £125, we will look at your

circumstances and be able to provide initial advice and an estimate of costs going forward.

Our professionals fees are likely to vary from £750 for a straight forward case to

in excess of £4,000 for a more complex case. Hourly rates vary from fee earner to fee earner,

but this estimate is based on an hourly rate of £200.00 p/h.

The fees set out above
exclude the following;

  *   Counsel's fees in relation to advice on merits/quantum

and/or representation at Court.

Depending on the seniority of the barrister instructed,

a reasonable estimate is in the region of £600 for a case management/directions hearing

and in the region of £1,000 - £1,200 per day for trial.

  *   Any fees associated with mediation or alternative dispute resolution

A referral to ACAS' dispute resolution service is obligatory before

commencing court proceedings, this a free service.

  *   Any disbursements such as Court issue fees, travel expenses, third party expense etc.

We are happy to provide a more accurate costs estimate once we have had the chance to

read any papers and taken instructions from you as to the issues in dispute.

Timescales

It is very often difficult to give an accurate time estimate for how long the process will take without

first knowing the details for your specific case, however this handy guide published by

HM Courts & Tribunal Service gives a clear overview of how a general claim will progress:
